Terms of Service

These Terms of Service ("Terms") govern your use of Calisthenics for Nerds, a mobile application provided by Labo Papillon Inc. ("we", "our", or "us"). By creating an account or using the app, you agree to these Terms.

1. Account

You must create an account to use Calisthenics for Nerds. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when signing up and to notify us promptly of any unauthorised use of your account.

2. Use of the App

Calisthenics for Nerds is provided for personal, non-commercial use. You agree not to:

• Reverse engineer, decompile, or disassemble the app
• Use the app in any way that violates applicable laws or regulations
• Attempt to gain unauthorised access to our systems or other users' data
• Use automated tools to extract data from the app or its API
• Resell or redistribute the app or its features

3. Your Content

You retain ownership of the workout data, goals, and other content you input into the app. By using the app, you grant us a limited licence to store and process that data solely for the purpose of providing the service to you. We will never share your personal training data with third parties without your consent.

4. Intellectual Property

The app, including its design, code, progression algorithms, skill content, and coaching notes, is owned by Labo Papillon Inc. and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the app without our written permission.

5. Premium Features and In-App Purchases

Calisthenics for Nerds offers optional premium features accessible through in-app purchases on the Apple App Store or Google Play Store. All payment processing is handled by Apple or Google respectively — we do not store your payment information.

• Subscriptions renew automatically unless cancelled before the renewal date
• Refund requests are handled by Apple or Google according to their respective refund policies
• Premium access is tied to your account and is not transferable
• We reserve the right to change the features included in premium tiers with reasonable notice

6. Service Availability

We strive to keep Calisthenics for Nerds available at all times, but we do not guarantee uninterrupted access. The app requires an internet connection for syncing data. We may perform maintenance that temporarily affects availability; we will endeavour to schedule such maintenance during off-peak hours.

7. Health Disclaimer

Calisthenics for Nerds provides a training tracker and is not a substitute for professional medical or fitness advice. The exercise progressions and coaching notes in the app are educational in nature. Consult a qualified healthcare professional before starting any new exercise programme, particularly if you have a pre-existing medical condition or injury. We are not liable for any injuries or health issues that arise from following exercise progressions suggested by the app.

8. Disclaimer of Warranties

Calisthenics for Nerds is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of inaccuracies. Progression timelines and coaching cues are provided in good faith and may not be appropriate for all users.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Labo Papillon Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Calisthenics for Nerds. Our total liability for any claim shall not exceed the total amount you paid us in the twelve months preceding the claim.

10. Account Termination

You may delete your account at any time by contacting us at help@labopapillon.com. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
